Australian Court Rejects Thorpe’s Charles Prosecution Bid
Victoria's Court of Appeal on Sept. 28, 2026 dismissed Krautatungalung elder Robbie Thorpe's bid to appeal rejection of his private prosecution against King Charles III. Three judges found no real prospect of success, his third defeat since the 2023 Melbourne Magistrates' Court filing alleging continuing genocide since Sept. 28, 2022. A senior registrar refused the charges for not disclosing an offence known to Victorian law; the Supreme Court upheld that. Thorpe, 68, said "Australia is just totally in denial" and that without acts of terror and genocide policies Australia would not exist. He expects no fair domestic hearing. Leave to the High Court remains (about 10% accepted), then the ICC. "The International Criminal Court will expose Australia for what it really is — a lying, racist, illegal occupation committing genocide," he said. "We're exhausting the domestic remedies." Don Rothwell said "An individual cannot commence a prosecution." The Court of Appeal acknowledged the significance of the questions raised yet held only Victorian jurisdiction applied and no offence known to Victorian law was disclosed.
